The second application for release of Patrick Balkany, locked since his conviction for tax evasion on September 13, will be examined Tuesday, was learned Friday from his entourage and his lawyer.

The request of the mayor LR of Levallois-Perret (Hauts-de-Seine), held in the prison of the Health, will be examined at 13H30 by the Court of Appeal of Paris, said these sources, confirming information of the Parisian.

The decision should be taken under advisement.

On October 28, the Paris Court of Appeal accepted Patrick Balkany's first application for release, related to his four-year prison sentence for tax evasion on September 13th.

But the elected 71-year-old remained incarcerated because of a second sentence to five years in prison, pronounced October 18, for laundering tax fraud.

The court of appeal, granting the first application for release of the mayor of Levallois-Perret, has also set several conditions such as the payment of a deposit of 500,000 euros, which could block his release from prison.

At the hearing on his first application for release, on October 22, Patrick Balkany appeared tired in the box of the defendants, far from the banter and the superb which he had shown during the trial in the spring.

He had invoked his "age" and "state of health", including his operation "a tumor in the back" and heart weakness. "I'm just asking for some humanity," he summed up.

The mayor of Levallois-Perret has appealed his two convictions for tax evasion and money laundering, and must be retried in these cases.
