It is the incipit of the intervention of the lawyer Giosuè Bruno Naso, one of the defenders of Marshal Roberto Mandolini (at the time interim commander of the Appia Station) accused of forgery, for which the prosecution has asked for the sentence to 8 years of imprisonment, and calumny (prescribed crime) in the trial on the death of the 31-year-old boy on October 22, 2009, six days after the drug arrest."For some years now, in the judicial district of the Court of Appeal of Rome - the lawyer Naso has explained to the assize court, referring to the former head of the prosecutor's office, now president of the Vatican court - certain processes have been instructed in a somewhat particular way, that is with a great media appeal on the story, often even inspired by the prosecution itself, or at least tolerated, with surveys done in massive, obsessive form, I would dare to say in some cases even with intimidating profiles and with abuse of the use of telephone interception, above all to put the suspects or at least the subjects involved in the process in difficult situations.
This process has taken on a paroxysmal tone: I do not know if it is normal and legitimate that before a decision that will in any case affect the life, work, affections and psyche of the defendants, you judges and you popular judges are subjected to media bombardment such as what has been achieved here. Can you be waterproof? I do not know, because unconsciously this conditioning leaves its mark even among us defenders: is there anyone here who is convinced that Stefano Cucchi was not killed? Is there one that has the courage to say so? "
For the lawyer Naso, "Cucchi is dead, and in the face of this death we bow, but he was not killed. I am tired of confronting myself with trials made with this way of proceeding that recalls those of the Stalinist type, that is that they did not start from a secular and prudent search for a procedural truth to which we arrived step by step, but they started from a prejudice that in most cases arose from the personality of the accused to find in any case the evidence of the responsibility of that same defendant, because in any case that responsibility had to be affirmed. And here there was not much different done, in this as in other processes ".
