For the first time, Carlos Ghosn's lawyers are asking the Tokyo District Courts to overturn the proceedings against the former boss of the Renault-Nissan alliance. They accused prosecutors of concealing evidence of collusion with Nissan in an effort to strengthen the alliance with Renault. They consider their criminal investigation " unconstitutional and illegal ". And feel that they have specific elements that prove the innocence of their client.

According to Mr. Ghosn's lawyers, a plot was hatched in Japan by Nissan officials , senior officials of the Ministry of Industry, but also prosecutors of Tokyo to allow them to constitute " artificially " a file of accusation against the former boss of the Renault-Nissan alliance.

The lawyers accused Nissan of asking one of its employees in Lebanon to " steal " a computer that had belonged to a former lawyer for Carlos Ghosn. Prosecutors reportedly found evidence of financial malfeasance by Carlos Ghosn.

The former CEO of Renault and Nissan has been indicted in Japan for aggravated breach of trust. He is accused, inter alia, of having covered by Nissan losses on personal investments on the stock market.

But also to have the Middle East transfer funds from Nissan to finance the purchase of a yacht and investments of his son Anthony in start-ups in the United States. For lawyers, these charges are arbitrary and have been fueled by leaks to the Japanese media.

Carlos Ghosn's lawyers seldom provide evidence of what they are saying. They seek a cancellation of the proceedings. They are unlikely to succeed.

Prosecutors analyze each of their evidence with the utmost care. They are even more cautious before filing charges that they are confronted by a man as world famous as Carlos Ghosn. Which rejects all the charges against him.

Arrested last November for financial malfeasance he rejects, Carlos Ghosn has been under house arrest in Tokyo since his release on bail in April.
