The former State Councilor was defended by the lawyer Beniamino Migliucci.

The investigating magistrate Guido Salvini has decided to close the file without recognizing crimes and accepting the petition of public prosecutors Cristian Barilli and Antonia Pavan. Bellomo, who became known for suggesting the 'dress code' to his students and fellows, remains under investigation in Bari for extortion.

According to the magistrate of Milan the reports are not appropriate but there were no harassment or threats so there was no crime.

The investigating magistrate Guido Salvini in the provision with which he decided to close the investigation against the former State councilor, specifies that although "many of the requests addressed to the scholarship holders appear ineffective with those that are the normal characteristics of an academic collaboration relationship and they have often been insistently advanced by telephone calls late in the evening and by e-mail, it cannot be considered that they are valid for integrating a habitual behavior of harassment and threat ". Certainly, the magistrate continues to explain, it was "decidedly inadequate for a course for the preparation of the magistracy exam the circumstance, reported by numerous female students, according to which the proposal to become 'scholarship holders' was born from the external image of the girls and not from being distinguished by juridical knowledge in the first phase of the lessons. But even this circumstance in itself is not of criminal importance ".

"The activity carried out by Dr. Bellomo - continues Judge Salvini - in the management of his school has had as a consequence the maximum sanction, that of dismissal as Councilor of State, but with this the consequences of behavior, although certainly singular, are exhausted because, as far as at least the Milanese segment of the Science and Law course is concerned, no criminal conduct can be identified ". The investigating magistrate also points out that "many of the contacts between Bellomo and the students were not implemented unilaterally by the suspect, but were registered as part of a network of exchanges characterized by reciprocity between the suspect and the female students ". 'Reciprocity' of which the prosecutors have also spoken asking for archiving.
