Säpo can make use of evidence which the accused may not access when they apply to expel a person who is considered a security risk. An examination by Eko of the Special Aliens Control Act shows that even the authorities examining the case must not take part in all of Säpo's evidence.

Decisions based on letters

A case of this kind is first tried by the Migration Board, followed by the Migration Court which submits an opinion to the Government. According to information from the Migration Court, the authority is not allowed to access the entire evidence base, but may in many cases decide on the basis of letters provided by Säpo. This is also confirmed by documents that Ekot has consulted.

Question for the legislator

In a case that was recently tried, the Migration Court finds that Säpo's investigation is not very specific in an opinion to the government. The authority also writes that:

"However, the information deficit that exists in these cases at the court and, to an even greater extent sometimes at the foreigner and his representative, is primarily a matter for the legislator"
