The Abu Dhabi Court of Cassation has overturned an appeal judgment, which punished a young man accused of possession and use of narcotic substances, and assaulted a policeman while performing his work, one year instead of five years, noting that the minimum penalty for any crime shall not be imposed. Drug, and sentenced the young man to five years.

The Public Prosecution accused the appellant against possession and abuse of hashish, in cases other than legally authorized, possession and abuse of psychotropic substances, and assault on the integrity of the body of a public official (anti-drug individual), that he resisted by force and violence, and beaten him, causing the injuries described in the report Medical.

The Criminal Court sentenced the defendant for the crime of resisting police officers to five years imprisonment and deportation from the state, and for the crimes of abuse of the psychotropic substance "amphetamine" and narcotics of hashish Acquisition of methamphetamine and hashish, confiscation of seized contaminated tools and metabolism of cannabis and imposition of penalties.

The convict appealed the verdict, and the Court of Appeal ruled in its presence to accept the appeal in the form, and in the matter, amending the appealed sentence to the confinement of one year for the assault on public official, and support him otherwise, and this judiciary was not accepted by the Public Prosecution .

The Public Prosecution called on the appealed judgment to amend the appealed judgment to imprison the appellant against him for one year for a crime that violates the integrity of the body of a public official who is wrong in the application of the law. 52/2 of the Federal Law No. 14 of 1995, on combating narcotic drugs and psychotropic substances amended to defect and require veto.

In its ruling, the Court of Cassation stated that this obituary is valid, since the amended Law No. 14 of 1995 on the Control of Narcotic Drugs and Psychotropic Substances, a special law stipulated in its article 65 that the penalty imposed by the application of this law shall not be imposed. As a result, the minimum penalty for any drug offense may not be imposed.

The court overturned the partially contested verdict in amending the appealed sentence for assaulting a public official, punishing the appellant with a five-year prison sentence, and otherwise upholding the verdict.
