The judges of the Supreme Court allowed the application of the new regulations pending the outcome of the ongoing legal battles. Under the new rules, only migrants who have been denied asylum in a third country or who are victims of "serious" human trafficking can apply for asylum in the United States.

Within the nine members of the US Supreme Court, composed of 6 men and 3 women, only the two liberal judges Ruth Bader Ginsburg and Sonia Sotomayor disagreed with the legitimacy of the restrictions on asylum applications. "Once again, the executive has enacted a rule that seeks to subvert long-standing refugee practices seeking protection against persecution," Sotomayor wrote.
