Two and a half years after the muscular arrest of Theo Luhaka in Aulnay-sous-Bois, a new medical expertise could change the course of the case. According to the report, the 25-year-old, who has been suffering from incontinence since his arrest, would need lifelong medical care.

It was at the city of the Wind Rose at Aulnay-sous-Bois in the Paris region. Theo Luhaka is challenged by four policemen for an identity check that goes wrong. Injured by a telescopic baton kick in the anus, the young man goes to the hospital with a tear of 10 cm.

The last medical report given to the examining magistrate last week is clear: " These injuries are in certain and direct relation with the arrest " and Théo Luhaka will need a medical follow-up for life.

This conclusion comes after two reports in February 2018 that were not to the benefit of the young man. The first contests any penetration attributing the tear of 10 cm to the force of the stroke of the baton and the other concludes that the blow was not contrary to the regulation.

So this new expertise could be a turning point. If at the end of the instruction Theo Luhaka is recognized a permanent disability, the case could be tried at the assizes, even if the qualification of rape had not been retained.
