At the microphone of Europe 1, Me Fabien Rajon, the lawyer of the family of a baby born with a malformation of the arm, explains the decision of its customers to file a complaint against X.

"In such a complex and sensitive case, we consider that an independent and impartial investigating judge must be seized," said Me Fabien Rajon. Asked by Europe 1 Monday, the lawyer of a family of Ain justifies the decision of his customers to file a complaint against X for "endangering the life of others", in the context of the children's case born with a malformed arm. "The investigations that are conducted to date by the health authorities" do not offer him the "guarantees" sufficient.

"We will stick to the results"

"It's the feeling of my customers," says the board. "They are in a logic to give themselves all the means to tend towards the manifestation of the truth, whatever it is, if this truth is that [the malformation is] the result of chance, or that it is "It is a poisoning of the mother, or another circumstance, we will stick to the results," he says.

"But we still have to give ourselves the means to achieve this," says Fabien Rajon, listing "a field survey, expertise, letters rogatory". "If a judicial inquiry is open, we can ask the investigating judge for analysis on a particular site, or expertise with this or that interlocutor," he explains. "This is our wish: do not remain passive, be active in this case and entrust this file to the right people."

No "excess of cases" according to expertises

In Ain, the Public Health France had indicated to have identified no cause for the group cases suspected of malformation last October. New expertise requested by the government has since, again, concluded the "absence of excess of cases" in the department.
