The PP presented last Friday in the Supreme Court a letter in which it informs the magistrates who will decide on their appeals against the Gürtel case ruling that the National Court is already studying two charges raised against José Ricardo de Prada , one of the magistrates who He dictated it.

The objective of the training led by Pablo Casado is to have the sentence annulled and, in any case, that the trial can be repeated - in which the conservative formation was condemned as a participant in a lucrative capacity -, with the argument that the challenged magistrate was not impartial.

The PP presented the aforementioned brief at the beginning of the month of August, a traditional period of judicial vacations and just the day the Prosecutor's Office asked the judge of the Punic case , Manuel García-Castellón , to impute the former Madrid presidents Esperanza Aguirre and Cristina Cifuentes for the alleged irregular financing of the party.

The sentence that the PP intends to annul is the one that led to the presentation of a motion of censure in 2018 that ended with the departure of Mariano Rajoy from the Executive and the investiture of Pedro Sánchez. That ruling is the one that the lawyer of the popular ones , Jesus Santos , has appealed in the Supreme Court to obtain his annulment and the repetition of the judgment.

Judge De Prada re-entered the Criminal Chamber of the National Court after going through the international court in The Hague and trying to achieve a vocal position in the General Council of the Judiciary. His reinstatement assigned him cases such as the case of PP box B and the investigation of cases of alleged corruption in the City of Boadilla del Monte .

The "honor of the PP, injured"

The defense of the PP understands that the challenged magistrate is the author of some of the harshest sentences expressed in the judgment against the PP and wields the possible violation of article 219.10 of the Organic Law of the Judiciary, which states that "they are causes of abstention and, where appropriate, recusal to have a direct or indirect interest in the lawsuit or cause. " Along these lines, remember that the European Court of Human Rights establishes that the "appearance of bias" of the courts can damage the confidence of citizens and call into question democratic institutions.

The PP presented the incident of challenge in April, based on the "notorious and close" friendship of De Prada with the disabled judge Baltasar Garzón and with the Minister of Justice of the Socialist Government, Dolores Delgado. It follows that De Prada has "direct or indirect interest" in this case. In addition, the popular insist that the sentence of the Gürtel includes "unnecessary expressions" that have "unjustifiably injured the honor of the PP".
