The Generalitat has found a "legal mechanism" that will allow this year that the officials of the Generalitat who wish to work two state holidays: December 6, Constitution Day, and October 12, the National Holiday of Spain .

The Minister of Digital Policies and Public Administration, Jordi Puigneró , has announced that the Government will approve a government agreement in September that will enable the legal formula for the Generalitat staff to work those two days.

The Minister wanted to make it clear that the option of working on those two festivities will be completely "voluntary . "

"We will not force anyone to party these two days, but we will enable the possibility that those who want to work these two days can do it," he concluded.

Asked if he fears challenges from the State , the Minister said: "We wanted to do it in accordance with the legislation and we have looked for the mechanism that will make it possible."

However, Puigneró has explained that until September the details of the formula that has been sought will not be disclosed .

The Minister recalled that last year he received a letter from many Catalan officials who asked to have the right to work those two days , not feeling represented by these holidays, and added that this demand is also supported by administration groups and some unions , among them the Intersindical-CSC.

This year Hispanic Day (October 12) falls on Saturday , while Constitution Day will be held on Friday .

Asked if the measure could also be extended to the staff of the Catalan municipalities , Puigneró explained that the request to enable those days as work days came from the employees of the Generalitat, and for now it will be launched for the Catalan government workers , which are more than 200,000.

"What may happen in other administrations is not my responsibility," added the Minister, who has left the decision to work or not those holidays in the hands of the municipalities.

In recent years a group of Catalan city councils, especially those governed by independentist formations, have opened their doors on October 12 and have made Hispanic Day workable for those officials who would like to work.

However, the controversy broke out in 2016 , when a judge, at the request of the Government Delegation in Catalonia, banned the opening of the Badalona City Council on October 12 and six councilors of that session decided to open the doors of the session and were then charged of disobedience

On the other hand, the Minister has made progress in working on a digital administration decree to address issues such as the use of big data or to advance objectives such as making the administration more and more computerized. and work every time "with less paper".

Likewise, this department wants with this decree to promote "proactive services" , that is to say, that the administration uses the data at its disposal to address a citizen to inform him that he is entitled to certain benefits.

This service would be provided as long as the affected party gave their consent to use their data and receive these notices, the minister has made clear.
