These are the pillars on which the so-called security law decree bis, which was definitively converted this evening by the Senate, is based.

Immigration
The provision authorizes the Minister of the Interior - with a provision to be adopted together with those of the Defense and Infrastructures, having informed the President of the Council - to limit or prohibit the entry, transit or parking of ships in territorial waters for reasons of public order and security; when the conditions set out in article 19, paragraph 2, letter g) of the United Nations Convention on the Law of the Sea of ​​Montego Bay materialize, limited to violations of the immigration laws in force.

In case of violation - by the commander of a ship - of the prohibition, a pecuniary administrative sanction is envisaged, from a minimum of 150 thousand to a maximum of one million euro and the accessory sanction of confiscation, preceded by immediate seizure of the boat. The costs of custody of the vessels subject to precautionary seizure are charged to the shipowner and the owner of the ship. When, on the other hand, the same boats are entrusted to the police, port authorities or the navy for custody in order to use them for institutional activities, the relative charges are charged to the administrations in charge.

Expected mandatory arrest in flagrante delicto or violence against warship. Established, at the Ministry of Foreign Affairs, a fund for repatriation policies aimed at supporting cooperation initiatives or bilateral agreements for the readmission of irregular foreigners present in the national territory and coming from non-EU countries. The fund has an initial budget of 2 million euros for the year 2019, which can be increased from an annual quota up to 50 million euros determined annually by inter-ministerial decree. The fund is intended to finance cooperation interventions through support to the general or sectorial budget; bilateral agreements.

Public order
More severe penalties in the event of violations, in the demonstrations, of the prohibition of the use of protective helmets, or of any other means to make the recognition of the person difficult. Prison for from 1 to 4 years is expected for anyone who, during the same events, launches or illegally uses rockets, firecrackers, smoke bombs, or blunt objects or, in any case, acts to offend, creating a real danger for the safety of people. For those who determine a real danger to the integrity of things, imprisonment from six months to two years is foreseen.

Harder penalties also for crimes of violence or threat to a public official, interruption of public service and devastation and looting, when the conduct is carried out during demonstrations. New type of damage done during the demonstrations, with imprisonment from 1 to 5 years and consequent applicability of the optional arrest in flagrante delicto.

More severe penalties even in case of insulting a public official and contempt of a magistrate at the hearing, with the exclusion of the tenuousness of the fact when the crime of violence or threat to a public official proceeds, of resistance to public official and public insult officer committed in the performance of their duties.

Sporting events
The scope of the so-called Daspo (prohibition of access to sporting events) is expanded; the protections currently provided for by the regulations for workers in the access gates to the facilities also extend to the arbitrators and other subjects called to ensure the regularity of sports competitions; the prohibition, for sports clubs, to grant tickets or other concessions, as well as to negotiate with the recipients of Daspo and preventive measures or with those affected for specific crimes, expands.

Modified the anti-mafia code to allow the arrest even for those who are seriously suspected of a crime committed on the occasion or due to sporting events. The institution of arrest in deferred flagrancy is stabilized both for violent crimes committed on the occasion or for sporting events, for which arrest is obligatory or optional; and when for the same crimes, performed in the presence of more than one person even on public occasions, arrest is mandatory.

The scope of the sanctioning regulation for the so-called bagarinaggio is widened, with the possibility for the mayor to order the removal of the touts from the railway and maritime stations, from the airports and from the docks of the buses.
