The document on the amendment of articles 108 and 109 of the Criminal Procedure Code of Russia was published on the official portal of legal information.
According to the new amendments, the investigation is obliged to justify to the court the reasons for applying for the extension of the term of the accused's detention.
At the same time, the period for which the arrest of the accused is extended shall be determined on the basis of the volume of investigative actions.
In addition, the list of persons in respect of whom a preventive measure in the form of arrest cannot be chosen is specified if they have a permanent place of residence in Russia and have not made any attempts to escape from the investigation or the court.
At the end of June, the Prosecutor General’s Office of Russia prepared proposals on measures against unwarranted arrests of entrepreneurs.
