According to the Ministry of Human Resources and Emiratisation, the fact that the worker exceeds the number of days of annual leave, due to the settlement of the excess days, when he returns to work again from the balance of the New Year holidays, is illegal and non-binding to the employer. In response to a question about the worker's eligibility to set his annual leave, the Ministry explained that this matter is up to the employer's discretion. The employer has the right to set the start date of the annual leave and, if necessary, to divide it into two periods at the most. For the events, while calculating the duration of the annual leave on holidays legally prescribed or agreement, or any other periods due to the illness, if this leave is part of it.

As for the rights of the worker at the time of the leave, the Ministry said: "The worker shall receive the basic wage plus the housing allowance (if any) for the annual leave days. If the working conditions require that the worker be employed during his annual leave, in whole or in part, The employer shall pay him a wage with a leave allowance for his working days equal to his basic wage. In any case, the worker may not be employed during his annual leave more than once during two consecutive years.

The Ministry added that the worker is entitled to receive his wages for the days of annual leave that he did not receive if he is dismissed, so that this allowance is calculated on the basis of the wage at the time of the entitlement of that leave from work, In addition to the legally mandated leave, prior to the worker's annual leave.

She pointed out that during his annual leave, a worker may not work for another employer, asserting that if his employer proves this, he is entitled to terminate the worker's services without warning and to deprive him of his wages for the period of leave.

10 days leave
