Lawyer Viktor Kasperavicius from Syktyvkar is trying to achieve re-qualification of the criminal case against Mikhail Glukhov, during the fight with which Viktor’s son was injured.

Last summer, 18-year-old Jan Kasperavicius arrived in St. Petersburg to apply to the university. On August 4, on the street, he saw a young man who was cursing with his companion, chasing her and spreading his arms. Yang interceded for the girl and was stabbed during the scuffle. Another indifferent passer-by, Dmitry Panfilov, helped Kasperavicius. He knocked the knife out of the hands of a man who was detained by police on call.

Panfilov also provided first aid to Jan Kasperavicius, who was then hospitalized. Video clips about how a fearless entrant came to the aid of a stranger and as a result he himself suffered were broadcast by the federal media.

In the Ministry of Internal Affairs of Russia in the Central District of St. Petersburg, Kasperavichus was given a letter of thanks for courage, dedication and active citizenship.

Against the girl’s companion, who was 32-year-old St. Petersburg resident Mikhail Glukhov, a criminal case was initiated under Art. 115 of the Criminal Code of the Russian Federation ("Intentional infliction of light injury to health"). Later he was retrained at st. 118 of the Criminal Code (“Causing grievous bodily harm through negligence”).

However, in December 2018, it suddenly turned out that, on the basis of the results of the examination of injuries, Glukhov himself had another criminal case brought under Art. 112 of the Criminal Code (Intentional infliction of moderate bodily harm) in relation to unidentified persons.

This news caused a wide public response. There are publications in the media stating that a young man who stood up for a woman and was injured could end up in prison.

The Prosecutor's Office of the Central District of St. Petersburg began to check the legality of the initiation of this case. According to the press service of the St. Petersburg prosecutor's office, the case in which Jan Kasperavicius himself could have become an accused was closed.

“Having assessed the evidence in the case, the inquest concluded that the use of physical force against Glukhov MP on the part of unidentified persons it was directed not to inflicting bodily harm on him, but to curbing the illegal actions of Glukhov MP, during which the latter showed a knife, ”the department’s press service said.

Investigation without witnesses

The investigation into Mikhail Glukhov has already been completed and is now being considered in court. However, lawyer Viktor Kasperavicius, Yana's father, categorically disagrees with the qualification of the crime accused by Glukhov. In his opinion, Mikhail should be judged not by art. 118 of the Criminal Code, and under Art. 111 of the Criminal Code - for the intentional infliction of grievous bodily harm.

According to Victor, the investigation of the case was conducted with violations - the inquiry ignored numerous witnesses to the conflict and video materials. Also, the lawyer is outraged that the police officers, according to him, did not take into account that Glukhov had already been convicted for attempted murder.

“The police were given the phone numbers of the witnesses, but in the end the entire inquiry was built only on the testimony of Glukhov, they did not establish a single witness. We brought Dmitry Panfilov to court, and earlier we filed a petition for recognition as a witness, but we were refused, ”noted Viktor Kasperavicius.

Yang himself says that during the investigation the investigative officers threatened to “take measures against him under art. 112 of the Criminal Code of the Russian Federation, up to arrest pending trial, ”if he and his father continue to insist on revising the article.

“And the accused himself was released from arrest on the second day, even though he already had an article for the attempted murder,” Syktyvkarets indignant. - And when we announced that we would be against this qualification, half an hour later we were given an agenda for a turnout under art. 112 of the Criminal Code of the Russian Federation as a witness, ”he recalls.

RT sent an official request to the State Department of the Ministry of Internal Affairs of Russia for the city of St. Petersburg and the Leningrad Region, but it was not possible to get an operational comment.

Case is closed

Now Yana's father is worried that the investigation of the case against his son can be resumed after the sentencing of Mikhail Glukhov.

If Glukhov is convicted under Art. 118 of the Criminal Code of the Russian Federation, it turns out that Yang acted illegally, and as a result he suffered serious bodily harm through negligence, - explains Viktor Kasperavicius. “After all, Glukhov, at the trial, says that he was walking with his companion, cursing, and ten people suddenly flew at him and started beating him.” As a result, he pulled out a knife for self-defense, began to wave it off, and accidentally hooked Jan, although he did not want to do that. ”

Jan Kasperavicius said that Mikhail Glukhov comes to the courts in a beautiful mood.

“I manage to observe Glukhov before the court, when he and his lawyer are sitting relaxed and laughing while waiting for the meeting. At one of those moments, I asked him if he would have laughed if he had killed me. None of them answered anything, ”recalls the young man.

According to him, during the meetings, Mikhail actively simulates the pain of injuries resulting from the scuffle.

“I made such a conclusion, because before the meeting there were no expressions of pain on his face, he felt comfortable and did not hold his hand, as he does during the entire meeting,” said Kasperavicius.

Yang himself has almost recovered from his injuries. “The consequences, of course, affect, but I try not to pay attention to it,” he said.

The next court hearing is scheduled for June 20, 2019, and Kasperovichus hopes that Glukhov will still be punished.
