According to the indictment, the defendant seized the profits of the veterinary clinic opened by her African partner and seized a rented villa for the clinic. She agreed with the victim to get herself 15%, but she took the clinic money and broke the partnership without giving him financial rights. .

The court heard the defense lawyer, Mahmoud Hanafi, who stated that his client was innocent of the charges against her and that the papers lacked evidence that would condemn her at all stages of the investigation.

He explained that the victim was a friend of his client, and that he had agreed orally with her to open a veterinary clinic, that she would administer and supervise the clinic.

He added that his client was surprised to send the victim an e-mail stating that he ended the partnership with her and asks her to find another investor in return for paying him the money he spent on the project. He pointed out that the first-degree sentence sentenced his client to four months imprisonment because she did not implement the agreement with the victim Accordingly, the funds have been squandered even though the partnership agreement was cured and not documented.

He referred to the absence of the elements of the crime because of the material and moral punishment, because the appellant did not receive any money from the victim to disperse it. The respondent paid her own money in return for extracting a license for the project, which meant that she did not dispense with the clinic. , Calling for the abolition of the appeal against his client, and the judiciary acquitted of the charges assigned to it.

A witness in the case stated that the victim paid the full amount of money for the establishment of the clinic. The defendant said that the charges against her were false and that she and the victim had an initial agreement to establish a veterinary clinic in the Emirate of Fujairah, where the victim rented a villa to open the clinic 88 thousand dirhams, and pay the rent alone.

She explained that the victim decided on his own to abandon the partnership that was between them, because it is not allowed to double work, and said that he sent by mail a letter to terminate the partnership with them in the project of the clinic, without requiring any money.
