HH Sheikh Hamdan bin Mohammed bin Rashid Al Maktoum, Crown Prince of Dubai and Chairman of the Executive Council, issued a decree No. (5) for the year 2019 on the installment of certain fees and fines due to government bodies in the Emirate of Dubai to enable people to fulfill their financial obligations to government agencies, And ease the financial burden on them in the performance of the general costs of government agencies, and increase the effectiveness of the process of collection of fees and fines due to the benefit of government agencies.

The decree stipulates that the government bodies in Dubai shall prepare lists of the fees and fines that they propose to be subject to the provisions of this resolution and submit them to the Department of Finance in Dubai for adoption, taking into consideration the regulations and standards adopted by the Department in this regard. Shall be entitled to approve the payment of fees and fines specified in such lists at the request of the governmental body of the persons to be paid or their legal representatives. Such request shall be decided in accordance with the conditions and procedures provided for in this resolution and the decisions issued thereunder.

In accordance with the decision, fees and fines are subject to several regulations, the most important of which are: Fees and fines required to be paid within the list of fees and fines that can be paid by the Department of Finance. The total fees payable by the student must not be less than 10,000 dirhams per person and 100,000 dirhams for individual institutions And legal persons.

The decision also stipulates that the total amount of fines payable by the applicant for installment payments shall not be less than 5000 dirhams per person and 20,000 dirhams for individual institutions and legal persons. The installment student shall pay at least 25% of the fees or fines to be paid.

The installments may be paid by one of the means specified by the Department of Finance, and the installment period shall not exceed two years. With the exception of the previous conditions, the Finance Department may, on the basis of a reasoned request submitted to it by the government authority, amend the minimum installments and amounts that may be paid .

The Director General of the governmental body or whoever is in his judgment shall determine by a decision issued in this regard the procedures to be followed when considering applications for installment fees and fines submitted to it in accordance with the provisions of this resolution.

According to the decision, the director general of the government agency or his authorized representative may, in accordance with the procedures adopted by the governmental authority in this regard, approve the request for deferral of payment of no more than three installments to individual persons and institutions that have agreed to pay the fees or fines due to them. The postponement of premiums is a fee of 100 dirhams of individuals and 200 dirhams from the individual institution and the legal entity. The government body in this context refers to the government departments, public bodies and institutions, authorities and government councils, which are subject to the general budget of the Government of Dubai.

The decision specifies some of the procedures that are taken in case individuals and individual institutions fail to pay installments. The government authority can cancel the installment process, pay the remaining installments in one lump sum and deny it the benefit of installment fees or fines in accordance with the provisions of this decision for a period of two consecutive years And the measures provided for in this resolution shall not prejudice the adoption of any measures or other measures provided for in the legislation in force to require individual persons and institutions to pay the amounts that they have failed to pay.

The Director General of the Department of Finance of Dubai shall issue the necessary decisions to implement the provisions of this Resolution and shall be published in the Official Gazette of the Government of Dubai. Executive Council Resolution No. (47) for the year 2014 regarding the installment of fines due to government bodies in Dubai shall be canceled. The extent to which the provisions of this resolution are inconsistent and shall be published in the Official Gazette and shall come into effect from the date of its publication.

Government agencies in Dubai shall prepare lists of fees and fines that they propose to be subject to installment.

The rest of the installments shall be paid in one lump sum in the case of individuals and individual institutions failing to pay premiums.

Grievance

The resolution provides that any interested party shall have the right to appeal in writing to the Director General of the governmental body of the decisions, procedures or measures taken against him under this decision within 30 days from the date of notifying him of the decision, procedure or measure against him. Submitted by a committee formed by the Director General of the governmental body for this purpose, and the decision issued on this grievance is final.
