Non-pecuniary damage
In a judgment rendered on April 3, revealed Friday by L'Express , the administrative court ordered the state to pay Yoann Barbereau the sum of "300,315.03 euros", including 200,000 for moral damages only. This "fair assessment" of the damage is linked both to the attacks that "damaged (reputation)" of Yoann Barbereau, to "attacks on his bodily and psychological integrity during his detention in Russia and then his compulsory internment in a psychiatric hospital ", with the" brutal "and" prolonged "separation from his wife and daughter, as well as with" attacks on his fundamental rights ", stress the administrative judges.
"After five years of injustice, this decision is a relief," responded Yoann Barbereau's lawyer, Me Olivier Arnod. "He is innocent and he did not commit any personal fault. It is fortunate that an impartial tribunal should say so, ”he added.
Other ongoing procedures
Yoann Barbereau was arrested in 2015 on trumped-up charges of pedophilia, he said. He had fled Irkutsk where he was placed under house arrest and had found refuge at the French embassy in Moscow. Convicted by default to 15 years of "penal colony" in a camp by the Russian justice, targeted by an international arrest warrant, he had fled a second time. He returned to France in November 2017 after an incredible 8,000-kilometer run from Siberia to Nantes.
Two other legal proceedings initiated by Yoann Barbereau are still in progress: one against the Russian State before the European Court of Human Rights (ECHR) and another to obtain the lifting of his red notice from Interpol.
