He explained that the court adopted the hybrid system to attend its headquarters, according to the situation, and it can be determined whether there is a need for the parties to attend in person or remotely, stressing its commitment to the target performance indicator with an average of 100 to 110 days to complete the case, while adhering to the principle (speed should not be on Account of justice), especially since some cases are resolved when the parties are given enough time to rethink resolving their differences.

In detail, Judge Khaled Al Hosani told "Emirates Today" that the Personal Status Court is committed before society and the state with the targeted indicators, whether with regard to the average time for completing cases or amicable settlements of family disputes before they reach the court.

The percentage of settlements in family lawsuits considered in the Personal Status Court in Dubai, was 94%, with 437 lawsuits during the past year, while the full mark was achieved in the estate settlements by 100% for the number of 300 files, which were amicably contained without referring them to the judiciary.

And it recorded an increase in its indicators during 2021, as the percentage of accuracy of judgments it issued, which was supported in the subsequent stages of litigation, reached 77%, compared to 75% in 2020, compared to 64% in 2019, and the percentage was 65% in 2018.

Al-Hosani explained that the Personal Status Court achieved remarkable positive results in the ratio and age of cases that exceeded a year’s adjudication period. The general ruling on cases heard by the court during the past year is 96.9%, compared to 79.5 in 2020, which witnessed the height of the Corona pandemic, and 94% in 2019.

Pointing out that there are marital disputes that are referred to the court, and both parties insist on separating, and over time, with the progress of the procedures, souls calm down, and the water returns to its normal course.

He attributed part of the boom in the court’s performance to the advanced technical system introduced by Dubai Courts in general, and the Personal Status Court in particular, since the Corona pandemic, if it helped greatly to speed up the litigation process, especially by allowing the parties to the lawsuit to attend remotely in cases that Let it.

He added that the technical system helped to insert the notes electronically in PDF or Word, which allows the judge to copy the excerpts he needs from them, unlike the previous one when he needed to manually re-copy these parts, a great effort that was consuming 50% of his energy. And his time.

He stressed that the procedures are now fully automated, and complete integration between departments and departments is achieved, so the judge is no longer waiting for a response from family guidance, implementation or other related departments, because there is one electronic file for the lawsuit, followed by everyone and adding to it each according to his role and specialization.

Regarding the attendance system to the Personal Status Court, Al-Hosani said that there are two experiences that the court conducted, personal attendance before the pandemic, and electronic appearance during the movement restriction period, and it decided, after studying and analyzing the results and experiences, to implement the hybrid attendance system, meaning allowing the parties to the lawsuit to attend in person if needed. The judge or the family counselor, or if they have a desire to attend, or to apply remote attendance in cases that do not require personal attendance.

He added that there are cases in which personal attendance is imperative, especially in the settlement stage, because eye contact and face-to-face talk have a much stronger effect than communicating via video or telephone, stressing that the Personal Status Court studies each case separately, and applies what it sees in the interest of the family and the parties to the case. .

remote signature

The President of the Personal Status Court in Dubai, Judge Khaled Al Hosani, confirmed that the technical system covers all stages of litigation, including remote signature, but in the end, like any other system, it can be exposed to an emergency malfunction, whether by the parties to the case, such as the difficulty of one of them entering the session. Because of a technical problem, or a system or internet failure, in which case the judge gives another time to attend, because justice is the basis, and each party must present its defenses without prejudice to its right to litigation.
