The "Measures" clarified that all levels of Shandong government should establish an emergency management mechanism that is unified command, coordinated, orderly, responsive, and efficient; production and business units should improve the emergency organization system, scientifically formulate emergency plans, and carry out emergency drills on a regular basis. If a production and business unit violates the provisions of the Measures and late or fails to report a production safety accident, the department of the people’s government at or above the county level with the responsibility of safety production supervision and management shall impose a penalty of 10,000 yuan (RMB, the same below) and less than 100,000 yuan Fines, if the circumstances are serious, a fine of not less than 100,000 yuan but not more than 200,000 yuan shall be imposed.
For illegal acts of production and business units that fail to establish emergency rescue teams or organize emergency team drills, a minimum fine of 10,000 yuan will be imposed.
The "Measures" also increased the penalties for non-obedience of the relevant people's government or the on-site command by production and business units.
In addition, the "Measures" also clarify that people's governments at or above the county level and relevant departments, township people's governments, and sub-district offices should organize at least one emergency plan drill a year, and emergency rescue teams conduct at least one rescue operation drill every month.
High-risk and densely populated units shall organize at least one comprehensive or special emergency plan drill every six months, at least one drill for all special emergency plans every two years, and at least one drill for all on-site disposal plans every six months.
Other production and business units shall organize at least one comprehensive or special emergency plan drill every year, at least one drill for all special emergency plans every three years, and at least one drill for all on-site disposal plans every year.
The Shandong Emergency Management Department stated that due to the lack of clear laws and regulations, the production safety accident emergency response work is not implemented, the response is not timely, the handling is not standardized, illegal command and rescue, blind rescue and other phenomena are common, and even appear in accident rescue.
