Mr. A was accused of undergoing a psychological evaluation at the hospital by falsely pretending to be a person with intellectual disability when he was judged as a first-class active duty soldier in the Military Examination of the Military Manpower Administration in 2007, and was subsequently accused of receiving a fifth grade of military exemption through military service re-examination. .

Prosecutors alleged that Mr. A gave false answers during intelligence tests, even though he was not actually an intellectually disabled person, as Mr. A was doing business or daily life without any discomfort.

However, the court said, "The reliability of the intelligence test received by Mr. A is high, and the results of similar tests were repeated in other psychological tests. "It is difficult to conclude that the defendant repeated the false answer and showed the same result."

The fact that Mr. A's academic performance was very low during his school years was also recognized as proof of the test results.

Prosecutors are guilty of proof that Mr. A's girlfriend B stated that "in light of his usual attitude, Mr. A did not think that Mr. A was an intellectually disabled person and that he was falsely registered as a disabled person and exempted from military service." I heard.
