A man in his 50s who was delusional and repeatedly assaulted his parents was sentenced to prison in an appeals trial.



Today (10th), the 1st Criminal Division of the Chuncheon Court of the Seoul High Court (Chief Judge Hwang Seung-tae) dismissed the appeal filed by Mr. A (52), who was handed over to trial on charges of violating the Act on Special Cases Concerning the Punishment, etc. He said he was sentenced to one year in prison.



On the night of October 3, 2021, at his home in Yeongwol, Mr. A was angry that his father, Mr. B (80), told him to turn off the bathroom light, screaming and grabbing his father by the collar and stepping on it. receive.



Also, on the afternoon of February 24 last year, when Mr. B told me to come out of the bathroom at home, he screamed in anger and hit Mr. B in the face. At the time, Mr. C (69), his mother, stopped it, but Mr. A rather stabbed Mr. C by the collar. He assaulted him by grabbing him and kicking him.



Accordingly, Mr. A was handed over to trial last year for habitually assaulting his parents on several occasions.



On March 2 of last year, he violated the court's order to ban access within 100m of his parents' home and workplace, and visited his mother and assaulted him.



As a result of the investigation, Mr. A was hospitalized in 2021 due to schizophrenia, etc., but after being discharged from the hospital, he fell into the delusion that his father, Mr. B, was taking hemp and taking drugs, and abused him.

The Yeongwol Branch of the Chuncheon District Law, in charge of the first trial, ordered Mr. A to be sentenced to one year in prison and *treatment custody.



The court of the first trial said, "The accused habitually assaulted his parents, the victims, without any convincing motive or reason, caught in a delusion." Severe punishment is inevitable considering the fact that the accused violated the law without any sense of guilt and assaulted him again."



However, he explained the reason for the sentencing, saying, "The reason why the defendant committed the crime was that the symptoms of schizophrenia, which he had suffered for more than 10 years, had worsened and it seemed that he was in a weak state of mind and body."



In response, Mr. A appealed on the grounds of misrecognition, misunderstanding of the law, and unfair sentencing.



However, the court did not accept this.



The appellate court said, "The victims have concretely and consistently stated the facts of the assault by the accused, and the victims of the deceased's crime have suffered considerable physical and mental suffering." It is heavy and cannot be seen as unjust," he said.
