A man in his 50s was sentenced to prison in the second trial for selling drunken customers a type of fake liquor, commonly known as 'Pingsul', and drinking it and leaving it unattended even though he lost consciousness.



On the 30th of last month, the 1st Criminal Division (Judge Hwang Seung-tae) of the Chuncheon Court of the Seoul High Court sentenced A (54), who was handed over to trial on charges such as quasi-fraud, to three years in prison and a fine of 1 million won, the same as the lower court.



In July of last year, Mr. A was indicted on charges of extorting 9.5 million won from Chuncheon three times by luring drunken customers to the establishment, feeding them so-called 'sweet liquor', which was made to look like new by mixing leftover alcohol, and then overcharging them. .



Mr. A, who led the crime, was also accused of killing a victim in his 40s who had lost consciousness in a bar due to excessive drinking until dawn.



At that time, the victim's blood alcohol level reached 0.342%.



A blood alcohol concentration of 0.342% is a level at which a person may become unconscious, and in severe cases, death may result from respiratory paralysis and cardiopulmonary arrest.



Mr. A, who appealed the verdict of the first trial, denied the charge of organic homicide even at the appeal trial, but the appeals court judged him guilty, saying, "Even though the death could have been sufficiently foreseen, no special protection measures were taken for the victim."



At the same time, he revealed the reason for the dismissal, saying, "The defendant committed the crime during the probation period, and it is difficult to see that the sentencing of the lower court exceeded the reasonable range of discretion."
