The court sentenced a resident to a fine for repeatedly removing the 'No Smoking Area' notice posted throughout the building.



According to the legal community today (24th), Detective 11 of the Seoul Central District Court (Judge Shim Hyeon-geun) sentenced Mr. A to a fine of 5 million won on charges of property damage.



Mr. A, who runs an internal medicine department in Gangnam-gu, Seoul, has had a conflict with Mr. B, the manager of the building, over smoking in the building.



Mr. B has been managing the building's elevators and toilet entrances and men's restroom urinals with A4 paper-sized 'No Smoking Area' notices attached to them, and Mr. A has been tearing them apart every day.



Combining the CCTV footage of the building and the testimony of the head of the management, the prosecution confirmed that Mr. A had removed the smoking cessation notice during work hours from October 16 to November 15 last year.



In the end, Mr. A's side, who was finally brought to court, argued that "there was no intention to damage it because it was an illegally posted advertisement."



However, the court said, "Even installations that do not obtain permission from a legitimate administrative agency are subject to a crime of property damage as long as they belong to others. can be requested."



He continued, "It is difficult to accept the claim that it is a legitimate act (removing the notice)," he said. .
