The Supreme Court mentioned the need for conditional release, saying, "The current system can only make a one-sided decision of detention and non-detention, so there is a limit to reaching an appropriate conclusion for each specific case."



The Supreme Court explained, "It is necessary to harmonize the principle of presumption of innocence and non-detention investigation and the protection of victims by introducing a conditional release system at the arrest warrant stage to replace detention under certain conditions." The release system is a system in which the judge dismisses the request for an arrest warrant and releases the suspect with certain conditions such as payment of a deposit, restriction of residence, third-party guarantee of attendance, attachment of electronic devices, and prohibition of access to victims.



The Supreme Court Judicial Administration Advisory Council has also been discussing the introduction of a conditional release system since last year.



Earlier, the Korean Bar Association also argued in a statement released yesterday that it is necessary to issue an order to attach an electronic anklet when the court dismisses a request for an arrest warrant in order to actively monitor perpetrators of stalking crimes.



Like Jeon Joo-hwan, who killed a station attendant at Sindang Station on the Seoul subway, a device is needed to prevent a stalker from approaching the victim in advance.
