 A man in his 60s who went upstairs due to noise between floors and swung a brick to break the front door and injure someone was sentenced to a suspended sentence in the first trial.



Today (19th), the Ulsan District Court announced that the 3rd independent criminal case was sentenced to 8 months in prison and 2 years of probation for Mr. A, who was charged with damage to special property and special injury.



In mid-March last year, Mr. A, who lived in an apartment in Yangsan, Gyeongsangnam-do, took a brick and visited Mr. B (43), a resident of the house upstairs to protest the noise between floors.



However, Mr. B did not open the front door, and Mr. A damaged the front door by hitting it with a brick several times.



When Mr. B opened the front door, Mr. A was handed over to the trial on charges of injuring 2 weeks of dislocation by swinging a brick at Mr. B's head and arms.



The court explained the reason for the sentencing, saying, "The guilt is heavy because the victim has not forgiven and the damage has not been recovered."



However, he said, "We took into account the fact that Mr. A committed the crime by accident after suffering from noise between floors for a long time, that he has now moved, and that the damage recovery is likely to be achieved due to the ongoing civil litigation between Mr. A and the victim."



Meanwhile, on August 23, the Ministry of Land, Infrastructure and Transport and the Ministry of Environment announced that they would strengthen the judgment standard by lowering the noise level between floors from the current 43 decibels during the day to 39 decibels and from 38 decibels at night to 34 decibels.
