In 1975, the then-Park Chung-hee government issued an 'Emergency Measure No. 9'.

Defaming or opposing the Yushin Constitution is punishable by up to one year in prison, and allows arrest and detention, seizure and search without a court warrant.

Over 800 people were arrested during the four years and seven months of emergency measures.

Until now, the courts have ruled that emergency measures are unconstitutional and invalid, but that the state is not responsible for compensation.

It was decided that the state was responsible for reparation to the victims.

Supreme Court interpreted the entire process from the issuance of 'Emergency Measure No. 9' to the related investigation and trial as a state action.



According to the National Compensation Act, when a public official intentionally or negligently inflicts damage on citizens, the state is liable for compensation.



Therefore, it was judged that a 'series of state actions' resulting from emergency measures constitutes an illegal act and that the state's liability for compensation is also recognized.

In 2015, during the Park Geun-hye administration, the Supreme Court said that although Emergency Measure No. 9 was unconstitutional and invalid, the issuance of emergency measure itself, a highly political act, cannot be regarded as an illegal act.



In addition, according to the emergency measure, the government ruled that the responsibility for compensation was not recognized for the work performed by individual public officials.



Accordingly, victims of emergency measures could not be compensated for damages unless individual faults of public officials were found in the process of implementing emergency measures.



But today, the Supreme Court overturned the previous case.



As of January of this year, there were 33 lawsuits for damages filed by the victims of Emergency Measure No. 9 against the state, and many of them are expected to receive compensation from this ruling.
