Celebrities Ana Morgade wins the legal battle against a man who harassed her
Each person celebrates their birthday in a different way.
There are those who look forward to it and organize a feast, others who live it like any other day and there are people for whom celebrating the day of their birth brings back bad memories.
This is what happened to
Keving Berling
, a worker at the Kentucky company Gravity Diagnostics who, after suffering several
surprise
panic attacks,
was fired
.
The affected affirms that he notified his superiors that
he did not want to celebrate his birthday
because it brought back memories of his parents' divorce.
But despite the warning, on August 7, 2019, during the lunch break, Berling found a "happy birthday" sign and congratulations from his colleagues.
After this, he went to his car where he claims that he had a panic attack.
The next day, during a meeting with the head of the company and a colleague to discuss what had happened, "he
verbally assaulted
both of them, clenching his fists and teeth, with a red face and trembling," according to an email sent by Gravity's lawyer. Diagnostics, John Maley, to AFP.
In this event, the supervisor and the employee "feared for their safety" which led the company to
fire
Berling, continues the representative.
The worker had never been sanctioned or reprimanded for his behavior before.
Berling sued the company after she was fired, accusing it of
discrimination on the basis of disability
.
The judge has ruled that she be awarded $150,000 for lost earnings and $300,000 for humiliation, loss of self-esteem and suffering caused.
The company maintains that
it was not informed
of the worker's anxiety problems and has filed an
appeal
.
Employers, particularly in this time of workplace violence, have the right and must take immediate action to protect their employees.
