After checking the CCTV, the head of the daycare center fired childcare teacher A and reported it to the police for child abuse.

However, in both the first and second trial on child abuse charges, Mr. A was acquitted.



The reason for the verdict was that "they have a somewhat harsh or coercive appearance, but they appear to have disciplinary or nurturing intent and do not appear to be being treated emotionally."



Person A, who had been dismissed, applied for relief to the Labor Relations Commission during the trial, and the Gyeongbuk Provincial Labor Relations Commission and the Central Labor Relations Commission also ruled that the dismissal was unfair, saying, "The grounds for disciplinary action are recognized, but the dismissal is excessive."



He also ordered reinstatement within 30 days.



The president responded with an administrative lawsuit to cancel the unfair dismissal decision, and the court upheld the director's hand.



Although innocent, "acts that at least have circumstances surrounding child abuse from the point of view of ordinary and average people" were recognized, and "the plaintiff was unfairly dismissed, saying, It was decided that it could not be viewed as
