A man in his 40s who was sentenced to prison for abusing his one-month-old son was commuted in the second trial.

This is because the risk of further abuse has been reduced since the divorce from his wife.



According to the legal community today (21st), the Seoul Western District Court's Criminal Affairs Division 2 (Chief Judge Sang-jun Sang) broke the original court of appeal against A (40), who was charged with violating the Child Welfare Act (child abuse), and was sentenced to 10 months in prison and 2 probation. He was sentenced to two years and ordered 200 hours of community service.

The order to attend 80 hours of child abuse treatment classes remained the same.



In December 2018, while playing a game at home, Mr. A was accused of abuse by swearing at his one-month-old son because he was crying, then lifting his son up and acting as if he was throwing it on the floor.



In January 2019, while playing a game, he cursed when his son cried, and his wife, who saw it, was also accused of behaving as if he was throwing the child out of the window.



In August of the same year and in January 2020, it was also found that Mr. A continued emotional abuse, such as swearing at his young son.



The first trial judge sentenced him to 10 prison sentences, saying, "The quality of the crime is not very good.



However, Mr. A claimed that there was no abuse and that the divorced wife's statement was inconsistent, and in fact appealed for misunderstanding and unfair sentencing.



In response, the court of appeals said, "After the defendant divorced, interview negotiations with the victim were also restricted, reducing the risk of further abuse." I did.



“It does not appear that the victim has been abused habitually, and it seems that the accused has been working hard to raise the victim in his own way,” he explained.
