The court also rejected Professor Jeong's bail application.



This is the final judgment of the Supreme Court, which came out about two years and five months after the prosecution started a forced investigation in August 2019 in the so-called 'national situation'.



As in the first and second trials, the court judged that the evidence ability of the PC in the lecture room, which was arbitrarily submitted by the teaching assistant of Dongyang University, was recognized by the prosecution.



Prosecutors did not accept the claim of Prof. Jeong that the prosecution had illegally confiscated the PC and had no evidence.



According to some, Professor Jeong's case was overturned on the basis of the decision of the Supreme Court in November of last year, 'If a third party voluntarily submits an information storage medium owned and managed by the suspect, the right to participate must also be guaranteed to the suspect who is the owner'. predicted it would be.



However, the court said, "In the case of 'information storage media belonging to the possession and management of the suspect', where the right to participate should be guaranteed even for the suspect, not the voluntary submitter, the suspect has the right to manage or dispose of the information storage medium until the time of seizure and search or close proximity. He continued, "The PC in this case was stored in the lecture room for nearly three years on the premise that Dongyang University officials would use it for public use or deal with it in other ways. It was submitted to the prosecution,” he added.



The Supreme Court's decision is also expected to affect the trial of former Minister Cho, who was separately charged with corruption in the child entrance examination.

Prosecutor Han led the investigation as the head of the Anti-Corruption and Violence Department at the time of the investigation into the family of former Minister Cho Kuk.



Professor Jeong is accused of forging Cho Min's citation at Dongyang University and exerting illegitimate influence on Mr. Cho's entrance exams (obstruction of business, etc.) (violation of the Capital Market Act) was charged with a total of 15 crimes.



The first trial pleaded guilty to many of the charges against Professor Jeong and sentenced him to four years in prison, a fine of 500 million won, and a fine of 140 million won.



The second trial also found her guilty of all charges of corruption in her children's entrance exams and, as in the first trial, kept her in prison for four years.



However, the second trial judge differed from the first instance in some judgments, such as acquitting some of the charges of acquiring undisclosed WFM-related information and trading stocks, and reduced the fine and fines to 50 million won and 10 million won, respectively.



Professor Jeong, who had denied the charges and claimed innocence, appealed against the judgment of the appeals court.
