On the 13th, Kim Gun-hee's side filed an injunction with the court to ban broadcasting, saying it was unfair to broadcast this recorded file handed over to MBC.



Today, just one day later, the court decided that it could be broadcast except for the ongoing investigation into Mr. Kim and daily conversations unrelated to political views.



The main determinant factor was that Mr. Kim was a 'public figure' receiving public attention as the spouse of a presidential candidate.



In addition, Kim's views on social issues and politics were judged to be of public interest.



However, he pointed out that Kim may refuse to testify in future investigations regarding remarks related to the investigation.



He also said that complaints about articles dealing with him negatively or casual conversations with acquaintances do not correspond to political views that provide information necessary for voters to exercise their right to vote.



As for the recording file itself, it was judged that it was not illegal under the Communications Secrets Act because the conversation partner recorded it himself.



Regarding the court's decision, Mr. Kim's lawyer said that it was fortunate that some content was banned, and that if MBC broadcasted it, he would see the content and consider legal action.



MBC said that it has no official position on the court decision, and that the production team, who has been preparing for the broadcast, will directly review the court decision and decide whether to broadcast or not.
