As the investigation revealed that Jang was taking drugs six days before the accident, the issue in this case became 'whether Jang was able to drive normally due to drugs at the time of the accident'.



The fact that Jang was punished 3 times for driving without a license in the 8th episode and the drug war also supported the possibility of driving under the influence of drugs.



Accordingly, the prosecution argued that it was a crime of dangerous driving under the Act on Aggravation of Certain Crimes, not a manslaughter under the Traffic Accident Handling Act.



The court of appeals judged, "It cannot be concluded that the accused is a chronic methamphetamine based on the criminal history alone, and symptoms such as exhaustion and lack of sleep may be caused by factors other than methamphetamine."



Considering that Jang had been driving a considerable distance before the accident and talking on the phone right before the accident, it was not possible to conclude that the symptoms of chronic methamphetamine had developed.



However, in terms of sentencing, the prosecution accepted the prosecution's argument and increased the sentence from three years to four years in prison.



The court pointed out that "the victim was crossing the road following the green light at the crosswalk, so there was no responsibility to turn it on the victim, whereas the defendant could have identified the victim if he had paid a little attention."
