A driver who was acquitted in the first trial for hitting and killing a person lying on an outskirts road with few people late at night was fined in the second trial. 



The 2nd part of the Criminal Court of the Cheongju District Court announced today (12th) that a fine of 10 million won was sentenced to a 51-year-old man A, who was indicted on charges such as manslaughter on the run under the Act on Aggravated Punishment for Certain Crimes.



On December 24, 2019, at around 4 am, Mr. A was handed over to trial on charges of driving a 5t refrigeration tower car on a road with a speed limit of 80 km/h in Osong-eup, Heungdeok-gu, Cheongju-si, and hitting 53-year-old B.



Immediately after the accident, Mr. A did not take any action, and Mr. B died from multiple injuries. 



At that time, Mr. B was lying on the edge of a one-way tertiary road in black clothes above and below.

It is not known why he was lying on the road at dawn. 



During the investigation, Mr. A stated to the effect that "there was a shock as if something was stepped on on the right rear wheel, but I never imagined that it was a person." 




The court of first instance acquitted the court, saying, "The accident occurred where there were no private houses or commercial facilities, and only guard rails were installed without sidewalks, so it is difficult to predict the possibility of people passing or lying down."



However, the prosecution appealed by adding the charge of not taking action after the accident as a preliminary indictment.

It is said that Mr. A did not fulfill his duty of relief measures because he did not check when he got out of the car even after recognizing that he had hit something. 



The second trial court ruled that "relief measures are the driver's duty to take promptly when a person dies, gets injured, or damages something." . 



He explained the reason for the sentencing, saying, "The accident occurred in a place where there were no obstacles such as speed bumps, so if you felt shock, vibration or sloshing, you should immediately stop and check what the object was."
