The Ulsan First Criminal Division of the Busan High Court (Chief Judge Hae-bin Park) overturned the 4 years and 6 months of imprisonment of the lower court in the appeals trial against Mr. said.



Mr. A was charged with killing his 8-year-old son by pressing a pillow on the head of his 8-year-old son at his residence in Yangsan, Gyeongnam in December 2020.



At the time, it was revealed that Mr. A and his son ate a lot of drugs and tried to make an extreme choice, but failed and killed his son.



In the police investigation, Mr. A stated that he committed the crime because he suffered from severe depression due to hardship after divorce.



The court of appeals denounced, "The act of killing a child while attempting to commit suicide with a partner stems from the erroneous notion that the child is one's property and should be severely punished." He said the reason for the commutation was explained.



He added, "This incident reflects the fact that the accused himself is suffering more than anyone else and that he seems to have to live with guilt and regret for the rest of his life, and that the parents and husband of the accused are pleading for mercy."
