A 40-year-old man who wielded a knife at his 4-year-old son and younger sister while arguing with his sister who offered to take his son was given a heavier punishment at the appeals court.



Today (6th), the 5th criminal division of the Seoul High Court (Director Kang-Yeol Yoon, Jae-Young Park, Sang-Chul Kim) of the Seoul High Court broke the first trial, which sentenced a person in his 40s who was handed over to trial on charges of attempted murder and child abuse, and sentenced him to five years in prison for three years They restricted employment in child-related organizations and ordered them to complete a 40-hour child abuse treatment program.



Mr. A was charged with attempting to murder his sister with a knife at home in January of last year and also wielding a knife at his 4-year-old son.



At the time, Mr. A raised his son alone after separation from his spouse, but he could not properly take care of him, so it is said that his sister was in fact raising him instead. 



Then, when the younger sister said, 'I will take my brother because he cannot afford to raise his son,' Mr. A argued, 'If you want to reunite with your (separated) spouse, you must have a son.'



In the process of arguing with his sister, Mr. A was outraged and swung a knife at his son and younger sister, which forced the younger sister to receive treatment for about five months and the son for about one month. 



In addition, Mr. A is additionally charged with long-term physical and emotional abuse, such as assaulting his son for not stopping crying in 2017, when his son was 6 months old.



At the end of the trial, Mr. A claimed that he had no intention of killing his sister, but the first trial judge did not accept this and found Mr. A guilty of all charges and sentenced him to three years in prison.



Based on the results of the sentencing investigation, the court of appeals judged a heavier sentence than the first instance, saying, "The child appears to have suffered a deep psychological wound, and the defendant's spouse also hopes to be punished. The original sentence is too light and unreasonable."
