A man in his 40s who sneaked into his ex-girlfriend's house and sexually assaulted him by adding toxic substances to food and cosmetics was also sentenced to prison terms in the appeals court.



Today (28th), the 1st Criminal Division (Presiding Judge Baek Seung-yeop) of the Daejeon High Court dismissed the appeal of a 46-year-old man who was charged with violating the Act on Special Cases concerning the Punishment of Sexual Violence Crimes (rape, etc.) He was sentenced to one year and six months, and was ordered to take 40 hours of sexual violence treatment lectures and to be restricted from employment in related organizations such as children and youth for five years.



On November 28 of last year, Mr. A was handed over to trial for finding out the password of his ex-girlfriend B's house, then sneaking in and putting herbicides in kimchi and cosmetics.



Victim B did not eat or use the kimchi and cosmetics when they smelled strange, so Mr. A's crime was only attempted.



One month later, at dawn on December 27, Mr. A was again sneaking into Mr. B's house and was caught by Mr. B.



Person A, who was found to have invaded at the scene, pointed a weapon at Mr. B, stunned him, and then sexually assaulted Mr. B. It was confirmed that B was injured for about 2 weeks in the anterior chamber due to this.



The first trial court sentenced A to three years and six months in prison, saying, "The quality of the crime is very bad and the psychological and physical shock suffered by the victim is very great."



Person A was dissatisfied with the ruling and appealed on the grounds that the sentencing was unfair, but the Court of Appeal dismissed it, saying, "Considering the conditions of the sentencing, it is difficult to see that the judgment of the first instance is beyond reasonable discretion."
