A man in his 40s who threatened to kill his ex-lover and his family with a pistol smuggled from abroad was commuted to the second trial.

According to the legal community today (7th), the 1st Criminal Division of the Daejeon High Court (Chief Judge Baek Seung-yeop) sentenced a 40-year-old man A who was charged with trespassing into a special residence, attempted murder, preliminary murder, violating the Immigration Control Act, and violating the Firearms and Explosives Act, sentenced to 5 in prison. The trial court overturned the previous year and sentenced him to 4 years and 6 months in prison.

The court also ordered A to 5 years of probation, and confiscated 1 confiscated pistol, 1 magazine, and 63 bullets.

In September last year, Mr. A was handed over to trial on charges of unsuccessfully trying to kill his ex-lover B and his sister C, whom he had secretly brought in a pistol from abroad and dated on the premise of marriage.

After breaking up with B in 2019, Mr. A purchased a 15-ton yacht in Croatia in January of last year.

Mr. A, who had been traveling around the world on a yacht, could not cast his hatred for Mr. B, who broke up, and bought 100 pistols and bullets near the Philippines in September last year and hid them and headed to Korea.

However, Mr. A's yacht was collided in the waters of Geomundo, Yeosu, Jeollanam-do, and the sail of the yacht was severely damaged, so he entered the port at Yi Sun-sin Marina, which is close to the accident area.

It is known that the CIQ (Customs, Immigration, and Quarantine) staff who manage immigration were not stationed at Admiral Yi Sun-sin Marina as it was not an open port for foreign ships, but a closed port.

Person A was tested for COVID-19 and quarantined on the yacht, but took advantage of the dawn of the 20th of the same month to land without immigration.

In the taxi, Mr. A went to Mr. B's house in Sejong City and aimed a pistol at Mr. B.

At that time, Mr. A threatened to kill for about 2 hours and 30 minutes, then gave up on Mr. B's persuasion and conciliation and surrendered.

It is known that in 2019, Mr. A threatened to distribute sex videos if he did not return any of the money he had lent after breaking up with Mr. B.

He was also accused of distributing false information by posting the identity and photos of Mr. B on an internet site several times.

Afterwards, it is said that Mr. A planned to kill himself and his family when he was accused of defamation by Mr. B.

The court of appeals explained the reason for the sentencing, saying, "There was no recovery of damage to the victims." "It is an act of ignoring the state's legal order, and the quality of the crime is very poor.
