A woman in her 30s who falsely accused her of being sexually assaulted by a male co-worker has been sentenced to prison.



The Cheongju District Court's 1st Criminal Division (Chief Judge Nam Seong-woo) announced yesterday (28th) that he sentenced 37-year-old A, who was handed over to trial on charges of innocence, to two years in prison and was arrested in court.



Mr. A filed a complaint with the police in May of last year saying that he was sexually assaulted twice by co-worker B at the company dormitory and motel in 2019.



However, Mr. B countered that there was no fact of having sex in the dormitory and that they had sex under mutual consent in the motel.

Mr. A countered that he was drunk at the time and was in a state where it was impossible to discern normal reason.



The court judged Mr. A's claim to be false based on the fact that Mr. A reversed his statement and transcripts when Mr. B's statement was consistent and specific, and evidence such as dormitory access records was presented.




The court ruled, "It is difficult to understand the behavior of Mr. A, who, instead of rebuking Mr. B, after the first sexual assault (asserted by Mr. A), first asked for his regards and used various emoticons to communicate and form a friendly relationship."



He said, "After the second sexual assault, Mr. A's statement that he took a taxi with me from the motel to the company is also unnatural," he said.



The court explained the reason for the sentencing, saying, "The accusation of acquittal confuses the state's investigative and judicial functions and causes unnecessary social costs."
