A 50-year-old man who sexually assaulted an acquaintance's underage daughter during an extracurricular class was commuted to the second trial. 



According to the court today (24th), Criminal Division 12-2 of the Seoul High Court (Judge Jin Hyun-min Kim Hyeong-jin Choi Bong-hee) sentenced 59-year-old A, who was charged with violating the Act on Special Cases concerning the Punishment of Sexual Violence Crimes (rape, etc.) to 7 years in prison. The trial court overturned the sentence and sentenced him to five years in prison.

At the same time, it was ordered to complete 40 hours of sexual violence treatment program and to be restricted from employment in facilities for children, youth, and the disabled for five years. 



In September and October of last year, Mr. A was sent to trial on charges of sexually assaulting and injuring Mrs. B several times while giving free tutoring classes to Ms. B, the daughter of an acquaintance, under the age of 13. 



During the investigation, Mr. A is known to have stated, "Miss B exuded sexual nuances" and "she seemed to seduce me." 




The first trial court sentenced A to 7 years in prison, saying, "The victim did not forgive him and the crime was not good." 



The second trial judge said, "Using his position as a tutor and personal trust, he sexually assaulted and even injured a victim under the age of 13." 



"There is a risk that the victim's development of a safe and harmonious personality, such as the formation of sound sexual values, may be greatly hindered, so a strict punishment commensurate with the guilt is inevitable." 



However, the court lowered the sentence to five years in prison in consideration of the fact that Mr. A acknowledged and reflected on the crime and that the victim sought forgiveness by paying the settlement money in November last year.



The prosecution requested that Mr. A be ordered to attach a location tracking electronic device (electronic anklet), but the court did not accept it as in the first trial, saying, "It is difficult to see that Mr. A is likely to commit a sexual violence crime again."
