the 19th, the victim who was stabbed to death by a knife wielded by Mr. Kim, who was persistently stalking, moved to a temporary shelter and was also protected by the police.

A total of 5 calls to 112 in the past 5 months.

The police have taken measures such as a ban on access in accordance with the Stalking Punishment Act, but they have not been able to stop the horrific crime.

Because of this, experts put their heads together as they pointed out the effectiveness of the current stalking punishment law.

As in this case, it was agreed that measures to prevent stalking in advance are far from reality.

Violation of the prohibition of access and prohibition of contact orders is punishable only after the fact, and the level of punishment is also to the extent of imposing a fine for negligence.

[Park Boram / Law Firm Empty Lawyer: This case also revealed how ineffective the measure of prohibition of access is currently in the stalking reality. Imposing fines for violating emergency measures... .]

Therefore, he points out that the police should actively utilize measures to temporarily imprison the perpetrators based on the judgment of the court.

[Park Boram / Attorney at Law Office Empty: The provisional measures stipulated in the Stalking Punishment Act include detention.

However, even in such a situation that the victim could not walk around comfortably and live his daily life, the perpetrator was not bound to his body.]

There were also voices calling for a review of the provisions on non-intentional punishment specified in the Stalking Punishment Act.

There are many cases where it is difficult to actively demand punishment because the victim is afraid.

[Kim Gu-seul/Researcher, Gender Law Research Institute, Ewha Womans University: In a situation where the fear of retaliation is great, it is difficult for the victim to express his/her intentions properly, and if punishment depends on the will of the victim, there is a high probability that the victim will feel guilty.]

One month from the enforcement of the Stalking Punishment Act A total of 3,314 reports of damage were received during the period.

It is pointed out that we should think about effective sanctions against the perpetrators rather than putting the protection of victims first.
