Mo Lee, a 76-year-old Rottweiler dog owner, was sentenced to the same sentence at the appeals court, who was fined in the first trial for biting a small Spitz dog while walking and injuring its owner.


The Seoul Western District Court's Criminal Case Division 1-1 (Chief Judge Seong Ji-ho) rejected the appeal of the prosecutor and sentenced a fine of 6 million won at the sentencing hearing of Mr. kept it.



Prosecutors demanded six months in prison in the first instance and on appeal.



Lee was handed over to trial on July 25, last year, on charges of causing a Spitz to die and injuring his dog owner by leaving a Rottweiler without a muzzle in a residential area in Bulgwang-dong, Eunpyeong-gu, Seoul.



The victim's owner suffered injuries for two weeks before being bitten by a Rottweiler, and the prosecution applied Lee to trial for violating the Animal Protection Act.



The court of first instance ruled that Lee was guilty of violating the Animal Protection Act applied to the part that injured the dog owner and not guilty of the charge of property damage applied to the part that caused Spitz to die.



There is no provision for negligence in the case of property damage, so punishment can be done only if the defendant's intentions are proven.



The court of appeals also maintained the judgment of the first instance, saying, "It is difficult to see that the defendant's dog was running out and biting the dog, but it was difficult to see that he did not do his duty on purpose.



This case also led to a civil lawsuit. Recently, Judge Joo Han-gil, the 36th independent judge of the Seoul Western District Court, ordered Mr. Lee to compensate the Spitz dog owner and others for a total of 8 million won.
