A husband who prevented his wife from spitting on the food she ate was convicted of property damage.



The first part of the Supreme Court confirmed the lower court sentenced a fine of 500,000 won to A, a man in his 40s, who was handed over to trial on charges of property damage.



A is accused of spitting on side dishes and stews placed in front of his wife because his wife was eating while on the phone in April of last year.



When his wife complained about 'spitting dirty', he spit on food again.



In the course of the trial, Mr. A argued that it was not a crime of property damage, saying, 'The side dishes and stews belong not to the wife, but to the person himself, and it cannot be said that he has harmed the utility of the food by his own actions.



However, the first and second trial courts acknowledged the crime of property damage, saying, "It is clear from experience that the food the victim was preparing and eating must not be owned by the victim, and that the utility of the food has been compromised as long as it is conscious that the food has been mixed with other people's saliva." I did.



The Supreme Court also admitted that there was no problem with the judgment of the lower court and found that Mr. A was guilty of the charge of property damage.
