The business owner, who had been closed for a week, filed a lawsuit to cancel the ban on gathering and won.



According to the Infectious Disease Prevention Act, an order to ban gatherings was issued, and the effective date was December 30 last year.



In October, it was only possible to impose fines for negligence, but it was judged that it was illegal to impose a ban on gatherings.



Another establishment was the first to be caught for violating seat spacing and not installing partitions, and was banned from gathering for two weeks.



This is because the ward office implemented the one-strike-out system in time for Halloween.



The court also ordered that this ruling be revoked.



In the case of the first violation, it is only a warning, and in the case of the second violation, the ban on gathering is only 10 days.



Before December 30 of last year, there were 486 establishments in Seoul alone that received a ban on gatherings for violating quarantine rules.



Of these, 17 filed administrative litigation and either won the case or applied for suspension of the execution of the disposition of the collective ban and were accepted.



The self-employed are preparing a massive legal response by collecting similar cases.
