On October 8, the government authorized the CSA to initiate a blocking procedure against any pornographic site that does not verify the age of its visitors.

Today, the vast majority of affected sites only display a warning message.

The National Commission for Informatics and Freedoms (Cnil) was seized on this subject by the Minister of Culture Roselyne Bachelot, Minister of Culture, indicates BFMTV reporting information from Next INpact.

In its opinion, the CNIL warns about the management of the personal data of Internet users and recalls that it is illegal to collect and record such information and consumption habits.

Data collection prohibited

The committee also recalled that it was forbidden to ask Internet users for an identity document so that they could prove their age.

"Such data collection would indeed present significant risks for the people concerned since their sexual orientation - real or supposed - could be deduced from the content viewed and directly linked to their identity" explains the CNIL.

These risks would be increased in the event of hacking or data leakage.

Instead, the commission suggests setting up a “trusted third party”.

The latter will be able to verify the user's identity document instead of the website and thus will not transmit any personal data.

Go through private providers

The only solution for pornographic sites, therefore: go through private providers.

In its opinion, the CNIL recalls that this age verification is only intended for sites dedicated to pornography, and not to sites on which pornographic content may appear among content of other kinds.

The CNIL has also expressed its opinion on the government's desire to refer certain Internet users to a CSA information page in the event of consultation of illegal sites, adds

It thus indicated that this referral should not lead to the collection of “personal” data from the Internet users concerned, “in particular their IP addresses”.
