On October 31, last year, Mr. A was charged with injuring 7 weeks of anterior teeth, including fractures of the lumbar vertebrae, when he collided with Mr. B with his car on a road in Pyeongtaek-si, Gyeonggi-do. 



A and B are known to have worked together at a so-called 'call jump' company that transports passengers in vehicles that have not been registered as a passenger transport business. 



On the day of the incident, Mr. A received a request from an acquaintance to retrieve the cell phone he left in Mr. B's car and asked Mr. B to confirm it.



However, Mr. B did not immediately comply with Mr. A's request for reasons such as 'the car is now at the car wash', and Mr. A suspected that Mr. B was not intentionally returning the cell phone and began to swear.



When Mr. A swears, Mr. B also swears. Mr. A, who heard this, was angry at the fact that Mr. B, who was 7 years younger than him, said, "I will kill you. Stay there." I drove my car to where I was going.

As a result of the investigation, it was found that Mr. A was driving at 30 km/h, and after finding Mr. B, accelerated to 44 km/h.



Mr. A claimed, "I had no intention of killing," saying, "It was my intention to drive quickly next to the victim and only threatened." But the appeals court did not accept this.




The Court of Appeal ruled that "the defendant's argument is difficult to accept in light of the speed and direction of the defendant's vehicle operation and the defendant's actions and facial expressions after the accident."



He continued, "The defendant and his defense claim that it is difficult to cause a fatal accident when driving at 44 km/h, but considering the instantaneous acceleration of about 15 km/h right before the impact, it is reasonable to assume that there is no effect on the establishment of the crime."
