A firefighter who took a resident to an ambulance and received 100,000 won filed an administrative lawsuit, claiming that the disciplinary action was unfair, but lost.



The Incheon District Court's Administrative Division 1-2 (Chief Judge Park Kang-gyun) announced today (21st) that the plaintiff lost the lawsuit filed by Firefighter A against the head of the Incheon Fire Station.



On September 22, 2017, Mr. A took Mr. B, a resident of Incheon, to his home by ambulance and received an envelope containing two 50,000 won bills.

In the fire department investigation, Mr. B stated, "I gave 50,000 won to Mr. A," but then confessed, "Actually, the money put in the envelope was 100,000 won." Mr. A, who denied the fact of giving and receiving money, also admitted that he received the money after receiving a cross-examination with Mr. B.



Mr. A attended the meeting of the disciplinary committee, said, "I will accept any punishment sweetly," and even wrote a letter of reflection.



However, when the fire authorities reprimanded him for violating the duty of integrity and violating the duty of integrity under the Local Public Officials Act, Mr. A filed an administrative lawsuit saying it was "unpleasant".



At the trial, Mr. A changed his words, saying, "I have never received an envelope with two 50,000 won bills from Mr. B." After saying, "I have received numerous commendations while serving faithfully in public office for nearly 30 years. If you look at the attitude, etc., the reprimand was abused beyond its discretion.”



However, the court judged that the fact that Mr. A received money and valuables was recognized and that the reprimand was rather a low level of disciplinary action.




The court ruled, "At the time of the investigation, Mr. A admitted to accepting money and valuables, and there seems to be no reason for Mr. B to make up lies to get Mr. A to be disciplined."



He continued, "A person's acceptance of money and valuables violates the duty of integrity, and the act of using an ambulance for personal use is a violation of the duty of integrity. "At that time, the disciplinary committee gave a disciplinary action that was one level lower than that of relegation or salary reduction," he said.



In addition, the court stated that the disciplinary action cannot be reduced with the commendation received in the past, as Mr. A's conduct of giving and receiving money fell under the rules of disciplinary action for fire officials.
