This was the first fatal accident since the enforcement of the so-called 'Minshik Act', which strengthened the penalties for drivers who injured or killed children in child protection zones.



In the event of a fatal accident, the penalty is imprisonment for life or three years or more without a fine.



At the first trial, the prosecution requested a four-year prison sentence for driver A.



The court applied the Minsik Act to Mr. A and sentenced him to 3 years in prison and 5 years of probation, and ordered 40 hours of social service and compliance driving lessons each.



A's side argued that the civil law should not be applied by driving at a speed of 9.1 km/h, which is less than the speed limit of 30 km/h.



However, the court held that even if the speed limit was observed, the Civil Code Act should be applied, saying that it did not fulfill its obligations such as a temporary stop.



In addition, he added that the driver also has an obligation to recognize the claim that he did not know whether it was a child protection zone.
