<Anchor> As the

issue of military sexual violence continues to surface, the Supreme Court overturned the previous ruling on the sexual assault charges that the military court had previously ruled not guilty of.

Another judgment came about that a military officer made multiple contact with a subordinate's body, reports Son Hyeong-an for more details.

<Reporter> It

was in the summer of 2017 that Mr. A, who was an officer at the Military Academy for Military Students, started physical contact with Mr. B, a subordinate non-commissioned officer.

On the street in July of that year, Mr. A said, "I should carry you," and grabbed Mr. B's hands and put it on his shoulder.

A month later, at a forest bathing area, I grabbed Mr. B's wrist and shoulder, telling him to come into the water, and that night at the screen baseball field, he held my hand behind Mr.

Mr. B complained that he had been touched four times without consent in a period of about a month, and in the end, Mr. A was handed over to the military court on charges of sexual harassment, etc.

In the first trial, A was sentenced to 2 years in prison and 3 years of probation.

However, the second trial accepted Mr. A's claim that it was just physical contact in everyday life and acquitted him.

The reason was that the fact that Mr. A touched Mr. B's body alone could not directly conclude that it was indecent, and that natural physical contact was expected.

But the Supreme Court reversed this again.

He said that only the act that Mr. A partially admitted constitutes sexual harassment, and that his intentions are fully recognized given the circumstances at the time.

[Sunmi Nam / Judge Research Officer in charge of public affairs at the Supreme Court: If we consider the relationship between the actor and the victim and specific actions comprehensively, it causes sexual shame or disgust in the general public… .] The

Supreme Court overturned the molestation part to the effect of guilt and returned the case to the Higher Military Court.
