As I said for a while, in January, our court ruled that the Japanese government indemnify the victims of comfort women by 100 million won per person. Although only the victims who participated in the lawsuit were different, but the contents were virtually the same, the conclusion that came out today (21st) was the exact opposite of three months ago.

Both the courts in the first lawsuit in January and the second lawsuit today had no disagreement that the removal of comfort women was a serious human rights violation.



However, the key issue with different conclusions is whether to apply the state exemption.



In other words, it is whether it is possible to establish a Japanese government in the courts of our country.



The 1st Litigation Court judged that crimes against humanity were not subject to state immunity, but if even crimes against humanity could not be held behind state immunity and held accountable, it was very unreasonable that it would not be possible to rescue victims of human rights violations.



But today, the second court of lawsuits said that Japan should admit state immunity based on customary international law and Supreme Court precedents.



He mentioned that if this is not admitted, a conflict of diplomatic relations is inevitable.



The 2015 Korea-Japan Agreement, unlike the 1st Court of Litigation, which said that the victims' right to claim compensation did not belong to the Korean government at the time, the 2nd Court of Litigation had procedural defects, but it is still valid as an agreement between countries and the rights of victims I saw that there could be some remedy.



In this way, due to different judgments of the judges, the grandmothers who suffered the same damage were legally placed in different situations.



The elderly victims of the second lawsuit are trying to seek the judgment of the superior court again, but the results of the sentence of the elderly victims in the first lawsuit have been confirmed due to Japanese response.



However, there are many practical obstacles for the grandmothers who have been victims of the first lawsuit to be executed.



Seizure of Japanese government assets is not easy, and the first litigation court decided at the end of last month that it could not ask the Japanese government for the cost of the lawsuit, saying, "You should be careful to enforce enforcement against other countries."
